Packaging EPR in the U.S. has reached the courtroom, which means the cost conversation around packaging has entered a new stage. According to Packaging Dive's Packaging EPR Goes to Trial, Maine was the first state to pass a packaging EPR law in 2021, Oregon became the first to implement one in 2025, and the National Association of Wholesaler-Distributors' challenge to Oregon's system is expected to enter a five-day trial in Portland from July 13 to 17, 2026

The way I see it, the point is not how U.S. lawyers fight the case. It is how purchase orders get rewritten. In the past, a brand might ask a print shop, "How much is this color box?" Now it will also ask, "Who is responsible for reporting this material, which states can we sell it in, and can we produce the recycling data?"

Packaging Dive notes that the court may issue a ruling before the end of 2026, and the result could affect later system design in states such as California, Colorado, and Minnesota. For Taiwanese brands whose goods enter U.S. retail channels, packaging specifications can no longer be treated as paperwork added after design. They need to be on the meeting agenda from the early design stage

Packaging design decisions used to be driven by "unit price." After EPR, they have to be judged by "life-cycle responsibility." For the same outer box, paper type, lamination, foil stamping, spot gloss, lining, and plastic hang tabs can each change later reporting and recycling responsibility

Take a skincare color box for export to the U.S. as an example. If the designer adds a matte film layer, the visual texture may improve. The purchasing side sees an increase in finishing cost. I would suggest print shops start with 5 tasks. Once these are done, there is no need for slogans. Sales teams will naturally have firmer ground when quoting

・Build a packaging material BOM: for every SKU, at minimum keep records for paper, film materials, ink, adhesives, lining, and outer packaging

・Complete supplier documents: paper sources, film specifications, recycling-related declarations, and version dates must be traceable

・Keep revision trails: for the same color box from V1 to V3, it should be possible to look back and see which material and which finishing process changed

・Add responsibility boundaries to quotes: state what data the print shop provides and what reporting the brand handles. Do not only write "produced according to client files"

・Manage U.S. clients by state: California, Colorado, Minnesota, and Oregon may develop different details in their EPR systems. Export projects cannot rely on one generic packaging answer
